Terms and Conditions for Lexmark Extended Warranty Service,
Lexmark OnSite and Lexmark LexExpress Warranty Service.
The terms and conditions of Lexmark Warranty Service apply to machines
which Lexmark has accepted for Warranty Service, including Extended
Lexmark Warranty Service, provided that the machine was originally
purchased, for company or individual use, from Lexmark, or a Lexmark
Authorised Distributor/Dealer (referred to in this statement as
Distributors/Dealers) in Singapore. Coverage is provided in Singapore.
Warranty Service Coverage
The coverage period is shown on the applicable Certificate of Registration
for Extended Lexmark Warranty Service for each covered machine,
or the coverage period is as specified under the statement of limited
warranty included in the user documents shipped with the machine;
whichever applies. The Customer is entitled to respective Lexmark
Warranty Service during the original warranty period specified in
the statement of warranty for a covered machine, if 1) OnSite Warranty
or 2) LexExpress Warranty or 3) Return to Base Warranty.
If the covered products include options, the options are covered
only when installed on the machine for which they were designed.
To obtain service for an option covered under Warranty Service,
it may be necessary to present the option with the entire machine.
Lexmark LexExpress Service
If the Customer chooses to use Lexmark's LexExpress service, an
exchange
machine will be shipped. The Customer must return the defective
machine to Lexmark, by packing it in the materials supplied with
the exchange machine. LexExpress Service is not available for
machines that have been defaced, altered, or damaged beyond repair.
When exchange service is used, the returned machine becomes the
property of Lexmark. Exchange machines may be new or repaired,
at the option of Lexmark. The exchange machine becomes the property
of the Customer when the machine to be returned has been received
by Lexmark and the exchange machine assumes the remainder of the
Warranty or Extended Warranty Service from the returned machine.
The returned machine must not be encumbered.
If the Customer chooses to have Lexmark repair and return the defective
machine, the Customer will be responsible for properly packing the
machine and taking it to the Lexmark Service Location. The Customer
is responsible for any damage resulting from the Customer's improper
packing of the machine sent to Lexmark.
Lexmark OnSite Warranty Service
Lexmark OnSite Warranty Service is provided at the Customer's business
or home location during the contracted Principal Period of Maintenance
(PPM). Next business day service will be provided within the contracted.
OnSite response time, provided the service location is within the
specified radius of the Authorised Lexmark
Service Provider. For the following condition, please add: one
(1) business day to the contracted OnSite response time for service
locations not within specific radius of the Authorised Lexmark Service
Provider there will also be an additional charge applicable. Lexmark
OnSite Warranty Service is not available for machines that have
be defaced, altered, or damaged beyond repair.
Extent of Warranty Service
Lexmark Warranty Service is not a guarantee of uninterrupted
or error-free functioning of a machine. Service does not include
repair of failures caused by: misuse, neglect, accident, modification,
electrical supply, operation outside of printer specifications,
improper maintenance by the Customer, failure caused by service
of the machine by non-authorised servicers, or failure caused by
a product, including supply products, for which Lexmark is not responsible.
Maintenance Kits
Certain service parts require periodic replacement based on usage
and yield, in order to maintain optimum performance of the printer.
Replacement of these items is a Customer responsibility, and Lexmark
Extended Warranty Offerings do not include the cost of maintenance
kits.
Repair Parts
Repair parts will be furnished on an exchange basis and will either
be new, equivalent to new or reconditioned. All returned parts and
products become the property of Lexmark.
Limitation of Liability
The Customer's sole remedy under the terms and conditions of this
Warranty Service is set forth in this section.
For any claim concerning performance or non-performance of Lexmark,
or a Reseller, for a covered machine under the terms and conditions
of Lexmark Warranty Service, the Customer may recover actual damages
up to the limits set forth in the following paragraph.
Lexmark's liability for actual damage from any cause whatsoever
will be limited to the greater of 1) $5,000 or 2) the amount you
paid for the machine that caused the damage. This limitation of
liability will not apply to claims for bodily injury or damage to
real property or tangible personal property for which Lexmark is
legally liable.
In no event will either party be liable for any damage caused
by the other party's failure to fulfil its responsibilities under
these terms and conditions. In no event will either party be liable
for any lost profits, lost savings, incidental damage, or other
economic consequential damages. This is true even if the other party
is advised of the possibility of such damage.
All expressed and implied warranties, including warranties of merchantability
and fitness for a particular purpose, are limited in duration to
the coverage period. No warranties, expressed or implied, will apply
after this period.
Cancellation
Either the Customer or Lexmark can terminate the Extended Warranty
coverage at any time with one (1) months prior written notice. When
the extended warranty coverage is cancelled, Lexmark will refund
to the Customer the remaining portion of the warranty price paid
on a prorata basis.
Additional Rights
Some states do not allow limitations on how long an implied service
lasts, or do not allow the exclusion or limitation of incidental
or consequential damages. If such laws apply, the limitations or
exclusions contained in the terms and conditions of this Warranty
Service may not apply.
This Warranty Service gives the Customer certain legal rights.
